General conditions for the sale of standards by the "Bureau voor Normalisatie" (Belgian Standards Organization) (NBN)
1.1 The NBN : The "Bureau voor Normalisatie" (Belgian Standards Bureau), created by the Standardization Act of April 3, 2003, and its implementation decrees, seated in 1070 Brussels, rue de Birmingham 131.
1.2 Customer: any natural or judicial person who purchases standards in paper or electronic version.
1.3 Standards: Belgian, European, International and foreign standards.
2.2 Standards can be ordered via the website of the NBN, by e-mail, letter or facsimile. In accordance with the present sales conditions, the contract for the sale and delivery becomes effective upon the written confirmation of an order by NBN or from the moment that NBN starts executing the contract. No other conditions govern the present contract, except those explicitly agreed upon in writing by NBN and the customer.
2.3 The NBN reserves itself the right to refuse certain orders. This can for instance apply to customers who have not (timely) settled earlier orders, in accordance with article 3 of the sales conditions.
Prices stated by the NBN are exclusive of VAT, delivery costs and possible discounts. The prices of foreign standards can vary according to exchange rate fluctuations and are therefore declared with the reservation that NBN may alter the prices.
4.1 The NBN will send standards included in its catalogue within five (5) working days after reception of the order, unless otherwise agreed. These and other possible delivery times are communicated to the best of our knowledge, but are not binding. In the case of foreign standards, the NBN will communicate an indicative delivery time for each order, as these cannot be delivered from stock.
4.2 If the stated delivery time is exceeded or if the ordered standards are (temporarily) unavailable, the NBN will consult the client. The mere fact that the delivery time has been exceeded does not entitle the customer to cancel the contract or to claim damages.
4.3 The return of a delivery by the client will only be taken into consideration by the NBN when it takes place within seven (7) days following the receipt of the order and provided the packaging of the paper version delivered standards has not been opened. The client will handle the standards with care when returning them to the NBN.
Sending back an electronic version is only acceptable when the client demonstrates that the said file is unreadable, even though he has the software that allows him to read the type of file concerned.
5.1 Standards ordered are paid by transferring the invoiced amount within 30 calendar days following the date mentioned on the invoice to the account of NBN: 000-3255621-10. No other term of payment is acceptable and indications placed by the client on the order form or any other document will be considered as null and void.
5.2 If the total amount of the order exceeds 1000 euro (exclusive of VAT), the NBN may ask the client to transfer the invoiced amount before delivery of the ordered standards.
5.3 In the event of non-payment on the due date of the invoice, a supplementary cost of 10 % will be charged on the amount of the invoice with a minimum charge of 25 Euro.
5.3 If the client does not protest the invoice in writing within fourteen (14) calendar days following the date of the invoice, he is deemed to have recognized the invoice as just and due.
6.1. ISO, IEC, ITU, CEN, CENELEC , ETSI and other national standards bodies have transferred their copyright to the NBN and entrusted it with the protection of their copyright interests in the Kingdom of Belgium.
6.2. Any reproduction, distribution, resale or communication of standards on any medium, is forbidden without the formal written authorization of the NBN.
7.1. The NBN accepts no responsibility for any use that the customer makes of the standards.
7.2. The client must ensure that the standards are appropriate to the use that he wishes to make of them. The client will also see to it that he receives the latest versions of the standards ordered, as well as any recent amendments and/or addendums, and will place his order accordingly.
8.1. Belgian law applies to contracts concluded in application of the present sales conditions.
8.2. In case of a dispute regarding the interpretation or execution of these contracts, both parties commit themselves to undertake all possible action in order to achieve an amicable settlement of the dispute.
8.3. Any dispute regarding the validity, interpretation or execution of such contract shall definitely be settled under the Cepina regulations, by one or more arbitrators designated in accordance with these regulations.
